The minutes of September meeting and the bills list were approved.
Brian Krise, who faces a fine for a floodplain ordinance violation, was the only visitor to comment. He asked if the Borough would withdraw its complaint or wanted to take the matter to court. Solicitor David Brann responded, "I think it has to go to court." He reviewed the circumstances that led to the Borough's complaint and said, "We must enforce the Floodplain Ordinance" or run the risk of cancellation for the flood insurance program for the Borough. Mr. Brann said, "There is an October 26 court date. Your counsel asked for a continuance and we did not contest it. We have had this before us for four months, and I don't want to rehash it any more. You still have not gotten a permit from DEP. We would put our Ordinance in jeopardy if we did not enforce it." Referring to the forthcoming Court date, Mr. Brann told Mr. Krise, "You might win," and said he would congratulate him if he won the case.
In agenda items, Mrs. Seeley said the Borough submitted application to Bradford County for a Community Development Block Grant of $20,000 to be used for sidewalk replacement for low to moderate income property owners. The Borough will be notified in the spring of 2016 if the grant will be awarded.
Council approved a resolution to deposit the State Pension Aid Distribution in the non-uniformed pension plan. Any overage will be returned to the Commonwealth.
Mayor Vineski received a letter from Cudd Energy Services stating that Cudd will permanently lay off approximately 89 employees at its Canton facility on or after November 30, 2015.
At the recommendation of Police Chief Doug Seeley, Council voted to hire Dalton Spencer, East Smithfield, as a part-time police officer. Mr. Spencer just graduated from Mansfield and was "Top Gun" in his class. The offer of employment to Michael Northup and Steve Davies as part-time officers was rescinded because they did not complete the paperwork.
Council approved a revised memorandum of understanding between the Police Department and the Canton Area School District.
Mayor Vineski set Trick or Treat from the end of the Halloween Parade on October 31 until 7:30 pm.
Although HRI, Inc. did not complete paving Sullivan and Chestnut Streets by September 30, Council decided not to seek liquidated damages amounting to $820 per day for two days. Mr. Bastion said the company had some equipment trouble. "They did a super job on Sullivan Street," he said, including filling in an area near the Canton Building Supply.
The new 2016 Ford F550 was to be delivered on October 13. No bids have been received for the 2011 Dodge Ram. It will be rebid and placed for sale online on Municibids. If there are no bids a private sale can be negotiated.
Council accepted a bid from Bristol Excavating of Troy for snow removal at $3,200 per removal. This will be used only in major snowfalls. Outside contractors were used once in 2015 and once in 2014. The vote was 5-1 with Mr. Jennings dissenting.
Fire Chief J., Scott May reported that the fire department has been awarded a Homeland Security grant of $219,600 to be used for new NFPA compliant self-contained breathing equipment.
Council voted to exonerate Tax Collector Gary Gleckner from collecting $472,50 in 2015 occupation taxes.
Council held an executive session for contractual matters for approximately 20 minutes. When the public meeting resumed, Council approved a motion to enter into an agreement with Code Enforcement, Inc. for Floodplain Management. The vote was 5-1 with Mr. Jennings voting no.
